Terms of Service

These Terms govern your use of Traphel, a marketplace operated by VMA Bubbles Consulting LLC, doing business as Traphel ("Traphel", "we", "us"), that connects visual creators ("Creators") with people who book them ("Clients"). By creating an account or using traphel.com (the "Service") you agree to these Terms and our Privacy Policy.

1. The marketplace

Traphel provides the platform — profiles, discovery, booking requests, messaging, gallery delivery, and reviews. Creators are independent professionals, not employees or agents of Traphel. The contract for any shoot is between the Client and the Creator; Traphel is not a party to it and does not guarantee any outcome, quality, or availability.

2. Accounts

You must be 18 or older. Provide accurate information, keep your credentials secure, and tell us promptly about any unauthorized use. You are responsible for activity under your account. We may suspend or close accounts that violate these Terms or put the community at risk.

3. Bookings and payments

A booking request becomes a booking when the Creator accepts it. Prices are set by Creators; a platform fee is shown before you send a request. When payments launch, they will be processed by Stripe: the Client's card is charged at booking, and the Creator is paid out after the shoot is complete via a delayed payout through Stripe Connect. Until payments launch, any payment arrangements made off-platform are solely between Client and Creator.

4. Cancellations

Clients may cancel free of charge up to 48 hours before the shoot. Cancellations inside 48 hours are refunded 50%. If the Creator cancels, the Client is refunded in full, automatically. Repeated or abusive cancellations may lead to account action.

5. Content and licenses

You keep ownership of content you upload. You grant Traphel a limited, worldwide, non-exclusive license to host, display, and transmit your content as needed to run the Service (for example, showing your portfolio, applying watermarks to previews, and delivering galleries). Rights to photos delivered from a shoot are agreed between Client and Creator. Do not upload content you lack rights to, or content that is unlawful, infringing, or abusive.

6. Reviews

Reviews must reflect a genuine completed booking and honest experience. We may remove reviews that are fraudulent, abusive, or violate these Terms. Ratings shown on profiles are computed from public reviews.

7. Acceptable use

No scraping, bots, or automated account creation; no circumventing fees by moving on-platform bookings off-platform after connecting here; no harassment, discrimination, or unlawful conduct; no attempting to break, probe, or overload the Service.

8. Disclaimers and liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Traphel is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the greater of $100 or the platform fees you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes, termination, and governing law

We may update these Terms; material changes will be posted here with a new effective date, and continued use means acceptance. You may stop using the Service at any time. These Terms are governed by the laws of the jurisdiction where VMA Bubbles Consulting LLC is organized, without regard to conflict-of-law rules.
